As a result of corruption in the lands office (thus government) KMA Housing Cooperative Society have lodged an indemnity claim of over 1 billion to be paid by the government of Kenya.
In 2007 the Kenya government (Lands Ministry) issued a title deed to KMA Housing Society to construct about 150 houses for its members . Members contributed millions of shillings with the hope that by 2009 they would have their dream homes along Mombasa Road near KAPA. As soon as construction commenced it was stopped because the apparent owner reported that he had not sold the land.
A court case ensued and 5 years later (2012) the high court found that the ministry of lands (and by extension the govt) did not protect the society from the conmen. Even the judge could not tell which of the titles produced in court was genuine.
The AG appealed against the decision and in 2016 the AG lost AGAIN. The appeal court judges concurred with the high court judges’ decision. In their judgement they ordered the government to take 2 actions:
- look for the conmen and prosecute them
and - INDEMNIFY KMA housing cooperative society. because the government had produced 2 “real” titles.
The indemnity case to have the Kenya government pay damages to KMA Housing Cooperative Sacco was lodged in 2016. But on the day the case was to be heard, advocates went on strike to protest the killing of their colleague by policemen. The judge hearing the case was later transfered to Machakos.
KMA Housing Cooperative Society has now filed for indemity of over 1 billion to try to recover the costs of the con and to alleviate the loss its members occured over 10 years ago. The case no. is 385 od 2017.
As KMA Housing Cooperative Society hopes to be indemnified soon, Kenyans have to look at the bigger issues that led to this loss of drs hars earned monies. They must learn from this and put their government in check:
- LANDS – corruption here produced 2 REAL titles that even after 2 years of due dilligence nothing suspect came up. That can only be collusion at the lands office and the government is liable
- LEGAL SYSTEM – They say the wheels of justice roll slowly. This is TOO SLOW. Drs invested millions and 10 years down the line they are waiting for at least a refund. These were young doctors who are now 10 years older and some have even died. The association suffered an unfair loss of trust by membership for a fault that was beyond its control.
KMA Housing Cooperative Society continues to follow the rule of law. We urge the Attorney General of the republic of Kenya to ensure that justice is done! Let the Kenya Government indemnify those poor doctors.
